Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was held in federal detention.

In her order, the judge pointed out that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
